Let's ignore the fact that the accusations are morally and ethically out of bounds as they accuse Obama of supporting terrorism and being indifferent to infanticide. Let's ignore the fact that they are ill advised from any perspective, and the only possible explanation is that the RNC is throwing red meat to it's base. Let's also forget what it says about a party that can only hold itself together by engendering hatred through despicable and degenerate lies. Let's even forget what the RNC should be doing to be a responsible political entity, to earn its role as a representative of the conservative perspective. Instead, let's take a look and see if what the McCain-Palin campaign and the RNC is doing is criminal fraud.
In criminal law, fraud is the crime or offense of deliberately deceiving another in order to damage them – usually, to obtain property or services unjustly. [1] Fraud can be accomplished through the aid of forged objects. In the criminal law of common law jurisdictions it may be called "theft by deception," "larceny by trick," "larceny by fraud and deception" or something similar.

Below are examples of fraudulent accusations made and approved by McCain and the RNC. There is no shady third party making these accusations. First, there is the robocall that directly connects Obama to terrorist activities that occured when he was 8 yrs old. The actual audio from the call is in the attached Fox news video with McCain's response. In assessing McCain's response, And before anyone claims media bias, this is Fox, they are no friend to Obama.
Here is the McCain-Palin approved mailer that tries to paint Obama as some one that does not support providing medical treatment for newborn infants.

The McCain-Palin campaign and the RNC are working to deceive Americans for personal gain. They are not expressing any opinion. they are not debating an issue. they are clearly accusing Barrack Obama of supporting terrorism and being indifferent to infanticide. There are no reasonable people (and very few unreasonable people) who could believe this is true.
This is criminal fraud.
